Deposit not refundable

At the beginning of May, I placed a 500 pounds deposit to reserve the car due to a long way from Oxford to Folkestone, I email them is the deposit refundable or not and Luke, the sale representative said it was completely refundable. When I arrived there, I checked the car over and realise the front driver seat wasn’t working correctly and Luke said it would be fixed. After that he showed me the sale order from, said that I need to sign it to secure the car, I asked Luke for any other term and conditions, but Luke told me that you can just sign as the deposit is fully refundable. I told him I was still waiting from the refund from BMW Finance and I am going to arrange my own HSBC finance for the car. In that case, if anything happened to the BMW finance or HSBC finance, will I be entitle for the full refund, he told me that it should be fine and you can get the money back. 4 days later, I called BMW finance to trace up the refund and they made an error, so I have to wait for 4 weeks for the refund. So I contact Luke from KAP immediately to show it to them regarding the error of BMW finance and I couldn’t be able to buy the car, I asked for my deposit back, he then told me to apply for their high apr finance first which I didn’t want to due to the high interest. Then I contact him to ask for my 500 pounds refund back, he told me that his director refused so in this case he couldn’t give my deposit back. Then I email them again to trace up the money and they send me the term and condition of the sale order, which is the separate page that I never read before or explain before by Luke as I was thinking Luke told me the right thing regarding the full refundable deposit. Now they told me that due to the term and condition of the sale order, the deposit is not refundable. So basically they will say things in a different way at different time. Their sale representative didn't even show me the term and condition at the time I signed and told me that the deposit is fully refundable, secondly, they will never show you the problem of the car actively until you find it out yourself (the broken chair motor), so don't buy the car and hand any money to them as you will not have your money back and they didn't really care you as a customer. Stay away.
