I bought a BMW 3 series from Den in October 2023. In order to take it away on the day I chose not to have it serviced. When the brakes failed a few weeks later, I put it down to bad luck and paid for the fix myself - the extra warranty that I'd been sold didn't cover it. The car failed its MOT in January 2024 for emissions and a missing catalytic converter - a straight pipe had been welded on instead. I went back to Den and he went on the attack straight away, claiming that I had removed it myself, or that it had been stolen, and criticising the garage that had failed the car - anything to avoid responsibility and having to pay. It was obvious that Den had sold me a car which wasn't road-worthy, and obviously I hadn't modded the car myself then taken it to an MOT. I asked Den to repair and re-MOT and he reacted angrily by text and threatening phone calls. He felt that he had no obligation to repair and again was very angry when I reminded him of his obligations under the Consumer Rights Act 2015. After a lot of back and forth, I brought it to Den's "independent garage" (his mate) who spent a few hours telling me the same old nonsense about how this car hadn't been originally fitted with a Cat, or that someone had stolen it and added on a straight pipe. They tried to dupe it through emissions tests to avoid fitting a new Cat. When this failed, several times, Den finally agreed to fit a new Cat, but insisted that we go halves on it. I was so tired after four weeks of his tantrums that I agreed and got out of there. I would not recommend buying from DW Smith Motors - if anything goes wrong you're on your own.
