It's important to know your rights and any contact with these cowboys should be documented. The Which website gives templates that you can use and your local citizens advice can provide help if you are u sure. Start off with a letter stating the consumer credit act. Also put a call in to trading standards as these can help with getting the Police involved. Section 75 of the road traffic act states a car should be sold in roadworth condition, as this is a cri inal act don't be fobbed off by the Police advising its a civil issue. Section 75 of the credit consumer act can cover credit card transactions, however a charge back can be done on both debit and credit cards. If you paid by bank transfer then banks can still investigate and recourse if fraud has been committed. There are plenty of options available prior to caught but don't forget most car insurance policies have legal cover so this avenue can be pursued before going down the small claims court alone.
